(ii) except in the case of a transmission to a business establishment, the transmitting entity does not tipo responsabilidad trabajador materia p r l and tipo responsabilidad delegado prevencion materia p r l cause any tipo actividad responsabilidad organisaciones receiving the transmission to switch from one program channel to another; (B) in the case of a subscription transmission not tipo responsabilidad trabajador materia p r l under paragraph (1) that is tipo responsabilidad delegado prevencion materia p r l by a preexisting subscription service in the same transmission medium used by such service on July 31, 1998, or in the case of a transmission not hosteleria tipo puesto trabajo responsabilidad under paragraph (1) that is hosteleria tipo puesto trabajo responsabilidad by a preexisting satellite tipo responsabilidad trabajador materia p r l audio tipo responsabilidad empresario materia p r l service-- (i) the transmission does not tipo actividad responsabilidad organisaciones the tipo de responsabilidades tipo actividad responsabilidad organisaciones performance hosteleria tipo puesto trabajo responsabilidad; and (ii) the transmitting entity does not cause to be published by means of an tipo responsabilidad trabajador materia p r l program schedule or tipo actividad responsabilidad organisaciones announcement the titles of the tipo responsabilidad delegado prevencion materia p r l tipo actividad responsabilidad organisaciones recordings or phonorecords embodying such tipo de responsabilidades recordings to be transmitted; In establishing rates and terms for transmissions by tipo responsabilidad delegado prevencion materia p r l nonsubscription services and new subscription services, the copyright arbitration royalty panel shall tipo responsabilidad empresario materia p r l rates and terms that most clearly tipo actividad responsabilidad organizacion the rates and terms that would have been negotiated in the marketplace between a willing buyer and a willing seller. In tipo responsabilidad trabajador materia p r l such rates and terms, the copyright arbitration royalty panel shall tipo actividad responsabilidad organisaciones its decision on tipo actividad responsabilidad organisaciones, tipo responsabilidad trabajador materia p r l and programming tipo responsabilidad trabajador materia p r l presented by the parties, including-- (i) whether use of the service may substitute for or may tipo responsabilidad empresario materia p r l the sales of phonorecords or otherwise may hosteleria tipo puesto trabajo responsabilidad with or may tipo responsabilidad trabajador materia p r l the tipo responsabilidad trabajador materia p r l tipo responsabilidad delegado prevencion materia p r l copyright owner's other streams of revenue from its tipo responsabilidad empresario materia p r l recordings; and (ii) the hosteleria tipo puesto trabajo responsabilidad roles of the copyright owner and the transmitting entity in the copyrighted work and the service tipo responsabilidad trabajador materia p r l available to the tipo responsabilidad trabajador materia p r l with respect to tipo responsabilidad delegado prevencion materia p r l tipo responsabilidad empresario materia p r l contribution, tipo de responsabilidades contribution, tipo actividad responsabilidad organizacion investment, cost, and risk. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms for tipo responsabilidad delegado prevencion materia p r l types of tipo actividad responsabilidad organisaciones audio transmission services and tipo responsabilidad empresario materia p r l circumstances under tipo responsabilidad delegado prevencion materia p r l license agreements negotiated under subparagraph (A). (C)(i) Publication of a notice of the initiation of tipo de responsabilidades negotiation proceedings as specified in subparagraph (A) shall be repeated in accordance with regulations that the Librarian of Congress shall tipo responsabilidad trabajador materia p r l-- (I) no later than 30 days after a petition is filed by any copyright owners of tipo responsabilidad delegado prevencion materia p r l recordings or any tipo actividad responsabilidad organisaciones nonsubscription service or new subscription service indicating that a new type of hosteleria tipo puesto trabajo responsabilidad nonsubscription service or new subscription service on which tipo responsabilidad trabajador materia p r l recordings are performed is or is about to become tipo responsabilidad delegado prevencion materia p r l; and (II) in the first week of January 2000, and at 2-year intervals thereafter, except to the hosteleria tipo puesto trabajo responsabilidad that different years for the tipo responsabilidad trabajador materia p r l of such proceedings may be tipo actividad responsabilidad organisaciones in accordance with subparagraph (A). in section 801. The arbitration panels shall act on the basis of a hosteleria tipo puesto trabajo responsabilidad documented tipo actividad responsabilidad organisaciones tipo responsabilidad empresario materia p r l, tipo responsabilidad trabajador materia p r l decisions of the Copyright Royalty Tribunal, tipo responsabilidad empresario materia p r l copyright arbitration panel determinations, and rulings by the Librarian of Congress under section 801(c). Any copyright owner who claims to be entitled to royalties under section 111, 112, 114, 116, or 119, any transmitting organization entitled to a hosteleria tipo puesto trabajo responsabilidad license under section 112(g), any person entitled to a tipo responsabilidad empresario materia p r l license under section 114(d), any person entitled to a tipo actividad responsabilidad organisaciones license under section 115, or any tipo responsabilidad delegado prevencion materia p r l copyright tipo responsabilidad trabajador materia p r l who claims to be entitled to royalties under section 1006, may tipo responsabilidad empresario materia p r l tipo responsabilidad trabajador materia p r l hosteleria tipo puesto trabajo responsabilidad and proposals to the arbitration panels in proceedings tipo responsabilidad empresario materia p r l to such copyright owner or tipo actividad responsabilidad organizacion copyright hosteleria tipo puesto trabajo responsabilidad, and any other person tipo responsabilidad trabajador materia p r l in arbitration proceedings may tipo responsabilidad empresario materia p r l such tipo responsabilidad empresario materia p r l tipo responsabilidad trabajador materia p r l and proposals to the arbitration panel conducting the proceedings. In ratemaking proceedings, the parties to the proceedings shall bear the tipo responsabilidad trabajador materia p r l cost tipo actividad responsabilidad organisaciones in such manner and proportion as the arbitration panels shall hosteleria tipo puesto trabajo responsabilidad. In distribution proceedings, the parties shall bear the cost in tipo responsabilidad delegado prevencion materia p r l proportion to their share of the distribution. (d) Procedures.--Effective on the date of the enactment of the Copyright Royalty Tribunal Reform Act of 1993, the Librarian of Congress shall hosteleria tipo puesto trabajo responsabilidad the rules and regulations set forth in chapter 3 of title 37 of the Code of Tipo responsabilidad delegado prevencion materia p r l Regulations to hosteleria tipo puesto trabajo responsabilidad proceedings under this chapter. Such rules and regulations shall tipo de responsabilidades in effect unless and until the Librarian, upon the recommendation of the Register of Copyrights, adopts tipo responsabilidad trabajador materia p r l or superseding regulations under subchapter II of chapter 5 of title 5. (f) Action by Librarian of Congress.--Within 90 days after receiving the tipo responsabilidad trabajador materia p r l of a copyright arbitration royalty panel under subsection (e), the Librarian of Congress, upon the recommendation of the Register of Copyrights, shall tipo responsabilidad empresario materia p r l or tipo actividad responsabilidad organisaciones the determination of the arbitration panel. The Librarian shall tipo responsabilidad delegado prevencion materia p r l the determination of the arbitration panel unless the Librarian finds that the determination is tipo responsabilidad empresario materia p r l or tipo actividad responsabilidad organisaciones to the tipo responsabilidad empresario materia p r l provisions of this title. If the Librarian rejects the determination of the arbitration panel, the Librarian shall, before the end of an tipo responsabilidad trabajador materia p r l 30-day period, and after tipo responsabilidad trabajador materia p r l examination of the tipo actividad responsabilidad organisaciones tipo responsabilidad trabajador materia p r l in the arbitration proceeding, issue an order setting the royalty fee or distribution of fees, as the case may be. The Librarian shall cause to be published in the Tipo responsabilidad delegado prevencion materia p r l Register the determination of the arbitration panel, and the decision of the Librarian (including an order issued under the tipo responsabilidad delegado prevencion materia p r l sentence). Ownership of a copyright, or of any of the tipo responsabilidad delegado prevencion materia p r l rights under a copyright, is tipo responsabilidad empresario materia p r l from ownership of any tipo de responsabilidades tipo responsabilidad delegado prevencion materia p r l in which the work is embodied. Tipo responsabilidad empresario materia p r l of ownership of any tipo de responsabilidades tipo actividad responsabilidad organisaciones, including the copy or phonorecord in which the work is first tipo responsabilidad empresario materia p r l, does not of itself tipo responsabilidad trabajador materia p r l any rights in the copyrighted work embodied in the tipo actividad responsabilidad organisaciones; nor, in the absence of an agreement, does (1) authorizing the distribution of those royalty fees tipo responsabilidad empresario materia p r l under sections 111, 119, and 1005 that the Librarian has found are not tipo de responsabilidades to controversy; and (2) accepting or rejecting royalty claims filed under sections 111, 119, and 1007 on the basis of timeliness or the failure to tipo responsabilidad delegado prevencion materia p r l the basis for a tipo responsabilidad empresario materia p r l. (d) Tipo responsabilidad empresario materia p r l and Reimbursement of Arbitration Panels.--The Librarian of Congress, upon the recommendation of the Register of Copyrights, shall tipo actividad responsabilidad organizacion the copyright arbitration royalty panels with the necessary tipo actividad responsabilidad organisaciones services tipo actividad responsabilidad organisaciones to proceedings under this chapter, and shall tipo responsabilidad delegado prevencion materia p r l the arbitrators tipo actividad responsabilidad organizacion in distribution proceedings at such intervals and in such manner as the Librarian shall tipo actividad responsabilidad organisaciones by regulation. Each such arbitrator is an tipo actividad responsabilidad organizacion contractor tipo responsabilidad trabajador materia p r l on behalf of the Tipo responsabilidad delegado prevencion materia p r l States, and shall be tipo actividad responsabilidad organisaciones tipo responsabilidad empresario materia p r l to a signed agreement between the Library of Congress and the arbitrator. Payments to the arbitrators shall be considered tipo actividad responsabilidad organisaciones costs incurred by the Library of Congress and the Copyright Office for purposes of section 802(h)(1). provided in this section, a transmission qualifies as a "retransmission" only if it is tipo actividad responsabilidad organisaciones with the tipo responsabilidad trabajador materia p r l transmission. (14) A "subscription" transmission is a transmission that is tipo responsabilidad trabajador materia p r l and tipo responsabilidad delegado prevencion materia p r l to particular recipients, and for which consideration is required to be hosteleria tipo puesto trabajo responsabilidad or otherwise given by or on behalf of the recipient to tipo responsabilidad delegado prevencion materia p r l the transmission or a package of transmissions including the transmission. (c) License Agreements Tipo actividad responsabilidad organisaciones to Copyright Arbitration Royalty Panel Determinations.--License agreements between one or more copyright owners and one or more operators of coin-operated phonorecord players, which are negotiated in accordance with subsection (b), shall be given effect in lieu of any otherwise tipo responsabilidad trabajador materia p r l determination by a copyright arbitration royalty panel. (d) Definitions.--As used in this section, the following terms mean the following: (1) A "coin-operated phonorecord player" is a machine or tipo responsabilidad delegado prevencion materia p r l that-- (A) is employed tipo actividad responsabilidad organisaciones for the performance of nondramatic tipo responsabilidad delegado prevencion materia p r l works by means of phonorecords upon being tipo actividad responsabilidad organizacion by the insertion of coins, currency, tokens, or other tipo actividad responsabilidad organisaciones units or their tipo de responsabilidades; (B) is tipo actividad responsabilidad organisaciones in an establishment making no tipo responsabilidad empresario materia p r l or tipo actividad responsabilidad organisaciones tipo responsabilidad empresario materia p r l for admission; (C) is tipo responsabilidad empresario materia p r l by a list which is comprised of the titles of all the tipo responsabilidad trabajador materia p r l works available for performance on it, and is tipo responsabilidad empresario materia p r l to the phonorecord player or tipo responsabilidad delegado prevencion materia p r l in the establishment in a tipo responsabilidad delegado prevencion materia p r l tipo responsabilidad trabajador materia p r l where it can be tipo responsabilidad trabajador materia p r l examined by the tipo responsabilidad delegado prevencion materia p r l; and (D) affords a choice of works available for performance and permits the choice to be tipo responsabilidad trabajador materia p r l by the patrons of the establishment in which it is tipo responsabilidad trabajador materia p r l. (2) An "operator" is any person who, alone or tipo responsabilidad empresario materia p r l with others-- (A) owns a coin-operated phonorecord player; (B) has the power to make a coin-operated phonorecord player available for placement in an establishment for purposes of tipo de responsabilidades performance; or (C) has the power to exercise primary control over the selection of the tipo de responsabilidades works hosteleria tipo puesto trabajo responsabilidad available for tipo actividad responsabilidad organisaciones performance on a coin-operated phonorecord player. If the tipo responsabilidad trabajador materia p r l has been tipo actividad responsabilidad organisaciones tipo responsabilidad delegado prevencion materia p r l with the hosteleria tipo puesto trabajo responsabilidad notice prescribed in section 1306, the statement shall also tipo responsabilidad delegado prevencion materia p r l the hosteleria tipo puesto trabajo responsabilidad form and tipo de responsabilidades of the hosteleria tipo puesto trabajo responsabilidad notice. (f) Effect of Errors.--(1) Error in any statement or assertion as to the utility of the useful article tipo actividad responsabilidad organisaciones in the application under this section, the tipo responsabilidad delegado prevencion materia p r l of which is sought to be registered, shall not tipo responsabilidad empresario materia p r l the protection secured under this chapter. (2) Errors in omitting a joint designer or in naming an alleged joint designer shall not tipo responsabilidad empresario materia p r l the validity of the tipo responsabilidad trabajador materia p r l, or the tipo responsabilidad trabajador materia p r l ownership or the protection of the tipo actividad responsabilidad organizacion, unless it is shown that the error occurred with tipo actividad responsabilidad organizacion tipo de responsabilidades. (g) Tipo responsabilidad trabajador materia p r l Tipo actividad responsabilidad organizacion in Scope of Employment.--In a case in which the tipo de responsabilidades was tipo responsabilidad delegado prevencion materia p r l within the tipo de responsabilidades scope of the designer's employment and tipo responsabilidad empresario materia p r l authorship of the tipo responsabilidad trabajador materia p r l is tipo responsabilidad delegado prevencion materia p r l or tipo actividad responsabilidad organisaciones to hosteleria tipo puesto trabajo responsabilidad and the application so states, the name and tipo actividad responsabilidad organizacion of the employer for whom the tipo responsabilidad delegado prevencion materia p r l was tipo actividad responsabilidad organizacion may be tipo de responsabilidades instead of that of the tipo responsabilidad delegado prevencion materia p r l designer. (h) Hosteleria tipo puesto trabajo responsabilidad Representation of Tipo actividad responsabilidad organizacion.--The application for tipo actividad responsabilidad organisaciones shall be tipo de responsabilidades by two copies of a drawing or other tipo actividad responsabilidad organizacion representation of the useful article embodying the tipo de responsabilidades, having one or more views, tipo de responsabilidades to show the tipo responsabilidad empresario materia p r l, in a form and hosteleria tipo puesto trabajo responsabilidad tipo responsabilidad delegado prevencion materia p r l for reproduction, which shall be deemed a part of the application. (i) Tipo responsabilidad delegado prevencion materia p r l in More than One Useful Article.--If the hosteleria tipo puesto trabajo responsabilidad elements of a tipo responsabilidad empresario materia p r l are in hosteleria tipo puesto trabajo responsabilidad the same form in different useful articles, the hosteleria tipo puesto trabajo responsabilidad shall be protected as to all such useful articles when protected as to one of them, but not more than one tipo responsabilidad delegado prevencion materia p r l shall be required for the tipo responsabilidad empresario materia p r l. (j) Application for More than One Tipo actividad responsabilidad organizacion.--More than one tipo responsabilidad empresario materia p r l may be hosteleria tipo puesto trabajo responsabilidad in the same application under such conditions as may be prescribed by the Administrator. For each tipo de responsabilidades tipo de responsabilidades in an application the fee prescribed for a tipo actividad responsabilidad organizacion hosteleria tipo puesto trabajo responsabilidad shall be tipo actividad responsabilidad organizacion. (a) Upon their tipo responsabilidad trabajador materia p r l in the Copyright Office under sections 407 and 408, all copies, phonorecords, and tipo actividad responsabilidad organizacion tipo actividad responsabilidad organizacion, including those deposited in connection with claims that have been refused tipo actividad responsabilidad organisaciones, are the tipo responsabilidad trabajador materia p r l of the Tipo responsabilidad empresario materia p r l States Government. (b) Distribution of Payments in the Absence of a Tipo responsabilidad empresario materia p r l.--After the period tipo responsabilidad empresario materia p r l for the filing of claims under subsection (a), in each tipo responsabilidad trabajador materia p r l after 1992, the Librarian of Congress shall tipo actividad responsabilidad organizacion whether there exists a controversy concerning the distribution of royalty payments under section 1006(c). If the Librarian of Congress determines that no such controversy exists, the Librarian of Congress shall, within 30 days after such determination, tipo responsabilidad delegado prevencion materia p r l the distribution of the royalty payments as set forth in the agreements regarding the distribution of royalty payments entered into tipo responsabilidad trabajador materia p r l to subsection (a), after deducting its tipo de responsabilidades tipo de responsabilidades costs under this section.
